Bird of prey nesting

Any guesses to which bird of prey this is.
The location of the nest is unusual - low down and close to a road. It's a biggish bird. It's underparts are very rufous, Red Kite?, but head is too dark? Not brown enough for Common Buzzard. Definitely not an Accipiter eg Goshawk etc. Not a Harrier (ground nesters). The sun maybe playing tricks with the colours.
Finn, can you go back and get a shot of it flying - wing and tail shape will confirm what it is.

I think it may have become too attached to the tree for it to fly.

Not "model" but moel, a Welsh word meaning bare.
