If you are going down the legal route then you will have to leave it until you get a resolution. To repair it I would try some warm PVA glue which will flow into the crack and close it up with some sash clamps. The worst thing you do is to start cutting into it to effect a repair - it will all end in tears.

Looks like it has already been filled to me, and opened up further in situ.

I don't think it would work trying to clamp it closed, and if it did the wood would be under strain trying to open back up again. If it's stable in this shape I'd be included to cut and inset a bit of Oak to give a tight surface.

Do you have offcuts of the worktop to play with?
